Adventure People Booking Terms & Conditions

These Terms and Conditions (the “Terms”) apply to all Adventure People Trips (“Trip” “Trips” or “Tour”) and govern the contractual relationship between you (the “Client” or “Participant”) and Adventure People (“Adventure People” or “Company”) with respect to any such travel products and/or services. 

Please read these Terms carefully as by booking any Trip with Adventure People, you acknowledge that you: i) have read and understand these Terms, and ii) indicated your express acceptance of and agree to be bound by these Terms. 

Conditions of Carriage: If your Trip includes carriage by sea, the Conditions of Carriage available at https://adventurepeople.net/terms-conditions/conditions-of-carriage/ also apply to your Tour, are expressly incorporated into these Terms and form part of your booking contract with Adventure People.

These Terms & Conditions are subject to change at any time with or without notice. Your agreement to these Terms & Conditions constitutes your agreement to any updates which can be found here.

Deposit and Booking Contract

A booking is confirmed and these Terms shall apply when Adventure People, or an authorized agent acting on Adventure People’s behalf, have received the applicable deposit from the Participant and the Participant receives a confirmation email from Adventure People. Please check your confirmation carefully and report any incorrect or incomplete information to the Company or authorized agent immediately. Please ensure that names are exactly as stated in the relevant passport.

The deposit paid upon booking is NON-REFUNDABLE, but should you need to cancel your participation on a Trip for any reason, you may request a CREDIT for 100% of your deposit amount that may be applied to any Adventure People Travel Club Trip which departs within one year from the departure date of the original trip, based on availability. Unused credits will expire after one year if not used. All deposits are non-transferable and may not be transferred to another person.

You must be at least 18 years of age to make a booking. You agree to provide full, complete, and accurate information to the Company.

Final Payment & Acceptance of Booking

As a condition of booking, you must provide the information requested by the Company, along with final payment of the balance of any Trip, 90 days prior to the start date of the Trip (the “due date”), unless otherwise stated. If you fail to supply information required by Adventure People for air tickets, permits, or other inclusions, you may also be liable for costs, fees, or losses including failure to obtain or provide that inclusion. In the event you fail to supply the information required by Adventure People, the Company also reserves the right to treat your booking as canceled and levy any cancellation fees. The information required will be communicated to you, or an authorized agent, during the booking process. Adventure People will not be held responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced, or otherwise incomplete information you have provided.

The Client may make payments towards the Trip balance as long as the full amount is paid by the due date. If payment is not received by the due date, Adventure People reserves the right to treat the Trip as canceled and shall retain the deposit paid on booking as a cancellation fee. If a Trip is booked less than 90 days before the departure date, then the full amount is payable at the time of booking in order for the booking to be confirmed. If for any Trip, payment terms differ from those outlined in this section, the applicable terms will be communicated to the Participant prior to booking and shall also be detailed on the applicable invoice.

Adventure People is not responsible for any charges levied or charged by third parties and/or financial institutions and payable by the Client as a result of credit card or other payment transactions in connection with the purchase of Trips and will not refund or return any fees charged by such third parties in connection with payments made by Participants to Adventure People.

Booking on Behalf of Others

By booking on behalf of another person or persons, you are deemed to be the designated contact person for every participant included in that booking. This means that you are responsible for making all payments due in connection with the Trip booking, notifying the Company if any changes or cancellations are required, and keeping your party informed of updates from Adventure People.

By booking on behalf of another person or persons,  you represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another Participant is complete and accurate and the Company will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.

Special Requirements

Any special requirements must be disclosed to the Company at the time of booking. The Company will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and the availability of options outside a planned itinerary. Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed to the Company at the time of booking but the Company cannot guarantee that dietary needs or restrictions can be accommodated. Any special requirements do not form part of these Terms or the contract between you and the Company and the Company is not liable for any failure to accommodate or fulfill such requests.  

Age Requirements

Unless otherwise indicated in the Trip description or by the Company, the minimum age for traveling on any Trip is 18 years old. Should you be traveling with a minor, all bookings are subject to review and approval by the Company. If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all consents and documentation ensuring that they and the minor(s) meet all legal requirements to travel, to enter into and depart from applicable countries and regions. The Company will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure necessary consents, permits, and approvals. 

Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behavior, well-being, supervision, and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. The Company does not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s). 

Insurance

CLIENT ACKNOWLEDGES THAT IT IS MANDATORY THAT THEY OBTAIN TRAVEL INSURANCE FOR ALL INTERNATIONAL TRAVEL WITH A MINIMUM MEDICAL EVACUATION AND REPATRIATION COVERAGE OF $200,000 covering all applicable dates of any travel with Adventure People and this insurance must cover personal injury and emergency medical expenses. Client acknowledges that they will not be allowed to join a Trip if they are not able to provide proof of insurance.

It is strongly recommended and encouraged that Clients also extend their coverage to include cancellation, curtailment, and all other expenses that might arise as a result of the loss, damage, injury, delay, or inconvenience occurring to the Client. The Client acknowledges that the cost of the Trip does not include any insurance coverage for such Client and that the Client is required to obtain separate coverage at an additional cost to the Trip price. When obtaining travel insurance the Client must ensure the insurer is aware of the type of travel to be undertaken so that the insurer may properly cover travel on the applicable Trip.

Pricing

Trips are priced and advertised inclusive of applicable sales taxes. Rates can only be guaranteed after a deposit has been paid by the Participant and a confirmation has been issued by Adventure People. Prices are per person, based on double occupancy. Advertised air-inclusive tour prices are based on the lowest-priced seating. All prices are in U.S. dollars. Adventure People cannot be held responsible for fluctuations in exchange rates when calculating refunds due to trip cancellations.

From time-to-time Adventure People may offer reduced pricing on selected Trips. The reduced pricing applies strictly to new bookings. Bookings that have already been confirmed are not entitled to the reduced pricing.

Single Supplements

Clients who are traveling alone are never required to pay a “single supplement.” Adventure People offers roommate matching to pair you with a same-sex roommate. Should there be an odd number of men to women, you may be asked to join a triple occupancy room. However, you may optionally reserve a single room for yourself, if you choose not to share with someone else. Please see the detailed itinerary for each Trip as the amount involved varies.

Airfare, Flight Delays & Cancellations

Tour prices do not include international or other airfare unless expressly mentioned in the Tour’s descriptions. The Company will quote the best price available for the travel dates requested at the time the quote is prepared. Quotes provide an estimate only and are not a firm price commitment by the Company or the applicable air carrier(s).

Adventure People acts only as a sales agent for the applicable air carrier and the air carrier terms and conditions apply to the purchase and use of the air travel ticket. Please consult the air carrier’s applicable Terms and Conditions and Conditions of Carriage for complete information including applicable cancellation terms.

Adventure People cannot be held responsible for any flight delays or cancellations caused by reasons including but not limited to weather, mechanical issues, or personnel strike. In the event of a flight delay, the Client must work directly with the airline to be re-booked. Once a new flight is confirmed, they must notify the Company of their new arrival time. If the Client is arriving later than the start date of the Trip, the Client understands that they may need to arrange transportation at their own expense to catch up with the group. Persons missing tour portions or components (including, but not limited to, meals, excursions, or sightseeing tours) due to flight delays or cancellations will not be refunded by Adventure People and will also not be eligible for a change of return date.

Cancellation of Trip by the Client

Your payments (excluding deposits) are refundable or movable to another Trip BEFORE the final payment due date, which is 90 days prior to the start date of the trip. AFTER the final payment due date, payments are non-refundable, non-movable, and non-transferable.

All cancellations must be advised in writing. We calculate your refund on the day we receive written notice of cancellation. The applicable cancellation fees shall be determined with reference to the date on which the request to cancel is received by Adventure People. All refunds will be processed within a few days of your cancellation.

Should you purchase a single supplement fee and decide later that you would like to share a room with another traveler, a refund will only be possible if there is another traveler to pair you with. 

Cancellation of a Trip by Adventure People

Departure for a Trip offered by Adventure People will become a guaranteed departure when the minimum number of travelers for that tour is secured by a valid deposit made on that departure.

The Company guarantees that all scheduled Trip departures booked and secured with a valid deposit will depart as indicated on the applicable confirmation, subject to reasonable itinerary changes as described in these Terms or good faith health and safety concerns. This guarantee is not applicable in the case of Force Majeure. Up-to-date Trip and itinerary information are available on the Company’s website or by contacting the Company. Brochures, trip packets, and other printed materials displaying Tour information and departure dates are subject to change and may not be relied upon for purposes of this guarantee.

If a Trip is canceled by Adventure People before the departure date for reasons other than Force Majeure and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from the Company:

(a) accepting from Adventure People a credit to be used towards another Trip; or

(b) accepting from Adventure People a full refund of all monies paid for the canceled Trip.

Adventure People is not responsible for any incidental expenses or consequential losses that the Participant may have incurred as a result of the canceled booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment. 

Flexibility, Changes & Unused Services

The Client acknowledges that by booking a Trip and/or agreeing to travel with Adventure People that the nature of adventure travel requires considerable flexibility and acknowledges that they will permit reasonable alterations to the Product and/or itinerary by Adventure People. The Client acknowledges their understanding that the route, schedules, itineraries, amenities, and mode of transport may be subject to change without prior notice due to circumstances or events, which may include sickness or mechanical breakdown, incidents in the location where the Trip will be operated, flight cancellation, strikes, events emanating from political disputes, entry or border difficulties, extreme weather and other unpredictable or unforeseeable circumstances which are beyond the reasonable control of Adventure People and that the Company is not liable to any Client for such changes or amendments. No reimbursements, discounts or refunds will be issued for services that are missed or unused after departure due to no fault of the Company, including your removal from a Tour because of your negligence or breach of these Terms.

Force Majeure

Adventure People will not be liable in any way for death, bodily injury, illness, damage, delay or orther loss or detriment to person or property, or financial costs both direct and indirect incurred, or for the Company’s failure to commence, perform or complete any duty owed to you if such death, delay, bodily injury (including emotional stress or injury), illness, damage, or other loss or detriment to person or property is caused by Act of God, war or war like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and wehere so lever any kkof the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather, significant risks to human health such as the outbreak of serious disease including any mutation or variation of, and the ongoing effects of COVID-19 or SARs-COV2, or any other cause whatsoever beyond the reasonable control of the Company or the Third Party Supplier of services, whether or not foreseeable, which would make it dangerous or not viable for a Trip to commence or continue, any and all of which, individually and collectively, constitute “Force Majeure”.

Travel Documents

The Client is entirely responsible for securing and must be in possession at all times, of all the required documentation and identification required for entry, departure, and travel to each country or region visited throughout the itinerary of the applicable Trip, and for re-entry to the Client’s country of residence or departure. Passport must be valid for 6 months past the last date of travel with Adventure People.

The client is also responsible for securing visas, permits, and certificates including vaccination or medical certificates, and insurance policies required for entry into all regions and participation in all parts of the Trip itinerary. The Client accepts full responsibility for obtaining all such documents, visas, and permits prior to the start of the Trip, and is solely responsible for any adverse consequences resulting from missing or defective documentation. The client agrees that they are responsible for the full amount of any loss or expense suffered or paid by Adventure People which are a direct result of the Client’s failure to secure proper travel documentation. It is the Client’s full responsibility to have the correct travel documentation.

Participant/ Traveler Accountability

You are responsible for being on time for activities and being at the designated places at designated times. You understand that you may be left behind if you are not on time at the designated places at the designated times and will be responsible for meeting the group at the next location. Any travel arrangements, meals, or activities as a result of getting left behind will be at your own expense. You will not be entitled to any refund for unused or missed services or costs incurred as a result of the termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.

You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on a Trip or, if in the opinion of the Company (acting reasonably), your behavior is causing or is likely to cause danger, distress, or material annoyance to others, the Company may terminate your travel arrangements on any product or service immediately at your expense and without any liability on the Company’s part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of the termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.

Adventure People maintains a strict drug policy. Regardless of the terms of discovery, any possession, use, or attempt to obtain illicit drugs when on a Trip will result in the decision and immediate removal of the Participant and termination of the remainder of travel with the group. The Participant will be wholly responsible for the costs incurred as a result of the termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.

You are responsible for any costs (including repair, replacement, and cleaning fees) incurred by the Company or the Company’s suppliers for property damage, destruction, or theft caused by you while on a Trip. You agree to immediately report any pre-existing damage to a representative of the Company and staff of the accommodation, transportation service, or facility as soon as possible upon discovery.

Adventure People reserves the right to remove a Participant from a Trip if your behavior is causing or is likely to cause disruption, danger, distress, or material annoyance to others. Negative behaviors may include but are not limited to adverse conduct resulting from alcohol consumption, disrespecting, harassing, or antagonizing others, bullying, gossiping, fighting, and yelling. The Participant will be wholly responsible for the costs incurred as a result of the termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.

You agree to assume complete financial responsibility for yourself during the Trip. You must be financially prepared for any and all incidental expenses whether explicitly or implicity, incurred on the Trip. Adventure People is not responsible for providing coverage or assistance for, and will make no accommodations related to, any charges (whether anticipated, additional, or otherwise) not expressly included within a Trip’s description. The participant must be prepared with the financial wherewithal reasonable for travel to, from, and within the Trip’s destination(s) for the entire duration of such trip.

You agree to bring any complaints to the Company as soon as possible in order to provide the Company with the opportunity to properly address such complaints. You agree to inform your trip leader, or another representative of the Company directly. The Company assumes no liability for complaints that are not properly brought to the attention of the Company and cannot resolve or attempt to resolve complaints until proper notice is provided. Any complaint made after the completion of a Trip must be received in writing by the Company within 30 days of the last day of travel of the booking in question.

Trip Leaders

Adventure People will provide a Trip Leader for our Small Group Trips whenever they are necessary for logistics and enjoyment of the Trip. The intended Trip Leader is often listed in the description of the Trip, however, Adventure People makes no promise of a specific person and there may be a different Trip Leader than the one indicated.

While on tour, the decision of the Trip Leader is final on all matters likely to affect the safety or well-being of any traveler participating in the Trip. If you fail to comply with a decision made by a Trip Leader or interfere with the well-being or mobility of the group, the Trip Leader may direct you to leave the trip immediately, with no right of refund. The Participant will be wholly responsible for the costs incurred as a result of the termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals. The Company may also elect not to carry you on any future trips booked. 

Required Medical Information

All Participants are obligated to provide requested relevant medical information to Adventure People upon booking their Trip and may be required to complete a medical information form (the “Medical Form”) depending on the Trip itinerary and for those with a pre-existing medical condition. 

Medical Forms are mandatory for certain itineraries and for those who have pre-existing medical conditions which may impact their ability to travel, participate in a Trip, travel to remote areas without access to medical facilities, or may adversely affect the experience of others on the Trip, it is required to submit a Medical Form, signed by a licensed and practicing physician, to Adventure People prior to or in conjunction with that Client’s final payment in respect of the applicable booking.

The Client agrees to complete the medical form honestly, and accurately and represents and warrants to Adventure People that they will disclose all relevant medical information accurately and fully. Adventure People will maintain the information in strict confidence, in accordance with the Adventure People Privacy Policy.

Adventure People reserves the right to deny any Client permission to travel or participate in any aspect of a Trip at any time and at your own risk and expense where the Company determines that your physical or mental condition renders you unfit for travel or you represent a danger to yourself or others. 

Pregnancy is considered a medical condition and must be disclosed to the Company at the time of booking. Adventure People may refuse to have women who are over 24 weeks pregnant participate in any of their Trips if reasonable accommodation or alternatives cannot be arranged. 

Adventure People will provide a written explanation for any such decision upon request from the Client. In the event the Client has made a booking with Adventure People and subsequently is unable to complete the required medical form for any reason by the deadline indicated above, Adventure People reserves the right to treat such Client’s booking as canceled, and all applicable cancellation fees shall apply.

Clients are responsible for assessing their own suitability and capability to participate in the Trip such Client has booked. You should consult your physician to confirm your fitness for travel and participation in any planned activities. Adventure People encourages all Clients to seek their physician’s advice regarding necessary or advisable vaccinations, medical precautions, or other medical concerns regarding the entirety of the Client’s travel with Adventure People.

Adventure People does not provide medical advice. Certain Trips may not be suitable for all people due to restrictions posed by limitations in mobility, physical or cognitive disability, pregnancy, or various other physical or mental conditions. It is the Client’s responsibility to assess the risks and requirements of each Trip in light of the Client’s limitations, physical and mental fitness condition, and any medical requirements or issues of such Client.

Adventure travel, by its nature, involves visiting remote or less developed regions, where medical facilities may not meet the standards of those found in a Client’s home country. The condition of medical facilities in the countries in which Adventure People operates varies and Adventure People makes no representations and gives no warranties in relation to the standard of such facilities or medical treatment in those regions.

Acceptance of Risk

The Client acknowledges that adventure travel and the products and services Trips offered by Adventure People may involve a significant amount of risk to your health and safety. By traveling with Adventure People you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risks and release the Company from all claims and causes of action arising from any losses, damages or injuries, or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in our Trip itineraries or otherwise offered by Adventure People. Adventure People requires that you confirm your assumption of this responsibility by completing a participation waiver (the “Waiver”) prior to departing on your tour. This can be found in the trip portal or in your confirmation email.

You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in “extreme sports” or other high-risk activities, or travel to countries with developing infrastructure. Standards of hygiene, accommodation, and transport in certain countries where Trips take place are often lower than the standards you may reasonably expect in your home country or region. You agree that the Company is not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges, or laws in effect in any locations where a Trip, product, or service is operated. You acknowledge you have considered the potential risks, dangers, and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.

You agree to take all prudent measures in relation to your own safety while on a Trip including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices, and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither the Company nor its Third Party Suppliers (as defined herein) are liable for loss or damages caused by your failure to comply with safety instructions or warnings.

Third-Party Suppliers

Adventure People works with third-party tour operators, accommodation providers, airlines, cruise lines, coach companies, transfer operators, shore excursion operators, local guides, and other independent parties (“Third Party Suppliers”) to provide you with some or all of the components of your booking. Third Party Suppliers may also engage the services of local operators and sub-contractors. Although the Company takes all reasonable care in selecting Third Party Suppliers, the Company is unable to control Third Party Suppliers, does not supervise Third Party Suppliers, and therefore cannot be responsible for their actions or omissions. Any services provided by Third Party Suppliers are subject to the terms and conditions imposed by these Third Party Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets, vouchers, and international conventions and agreements that govern the provision of their services. These may limit or exclude the liability of the Third Party Supplier. You acknowledge that the Company does not warrant any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.

Adventure People is not liable and will not assume responsibility for any claims, losses, damages, costs, or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress, or frustration, whether physical or mental, resulting from the act or omission of any party other than the Company and its employees.

Adventure People is not liable for the acts or omissions, whether negligent or otherwise, of Third Party Suppliers or any independent contractors.

Optional Extras

“Optional Extras” refers to any activity, transportation, meal, product, or service not expressly included in the Trip itinerary or price of a Tour and which does not form part of a Tour. You agree that any assistance given by the Company’s representative(s) in arranging, selecting, or booking, any Optional Extras is purely at your request and the Company makes no warranties and expressly disclaims any liability whatsoever arising from participation in Optional Extras or any information provided by any representative of the Company regarding any Optional Extras. You release the Company from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in or booking of Optional Extras.

You acknowledge and agree that any liability for loss, damages, death, personal injury, illness, emotional distress, mental suffering or psychological injury, or loss of or damage to property associated with Optional Extras is the sole responsibility of the third party providing that service or activity.

Liability

Adventure People and its parents, subsidiaries, and their respective employees, affiliates, officers, directors, successors, representatives, and assigns shall not be held liable for (A) any damage to, or loss of property or injury to, or death of, persons occasioned directly or indirectly by an act of omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by Acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against the Company for any such loss, damage, injury, or death.

In the event that any loss, death, injury, or illness is caused by the negligent acts or omissions of the Company or of the Third Party Suppliers of any services from which part of the booking contract then the Company limits its liability, where applicable by all applicable international conventions.

Carriage of passengers and their luggage by sea is governed by the Athens Convention relating to the Carriage of Passengers and their Luggage by Sea (PAL), as amended (the “Athens Convention”) which is expressly incorporated into these Terms and any liability of the Company and the Carrier (as that term is defined in the Athens Convention) for death or personal injury or for loss or damage to luggage arising out of carriage by sea will be determined solely in accordance with this Convention. The Athens Convention limits the Carrier’s liability for death or personal injury or loss or damage to luggage and makes special provisions for valuables. It presumes that luggage has been delivered undamaged to the Client unless written notice is given to the Company and/ or the Carrier:

(a) in the case of apparent damage, before or at the time of disembarkation or redelivery; or

(b) in the case of damage that is not apparent or of loss within 15 days from the date of disembarkation or redelivery or from the time at which such redelivery should have taken place.

Any damage payable by the Company up to the Athens Convention limits will be reduced in proportion to any contributory negligence by you and by the maximum deductible specified in Article 8 (4) of the Athens Convention.

In so far as the Company may be liable to you in respect of claims arising out of carriage by sea, the Company is entitled to all the rights, defenses, immunities, and limitations available, respectively, to the actual carrier and under the relevant Conventions, and nothing in these Terms will be deemed as a surrender thereof. To the extent that any provision in these Terms is made null and void by the Athens Convention or any legislation compulsorily applicable or is otherwise unenforceable, it shall be void that that extent but not further. The Company’s liability will not at any time exceed that of the carrier under its Conditions of Carriage and applicable or incorporated conventions or other legislation. Any liability in respect of death and personal injury and loss of damage to luggage which the Company may incur, whether under the contract with you in accordance with these Terms or otherwise, will always be subject to the limits of liability contained in the Athens Convention for death or personal injury.

Notwithstanding anything to the contrary elsewhere in these Terms, the Company will not in any circumstances be liable to you for any loss or anticipated loss of profit, loss of enjoyment, loss of revenue, loss of use, loss of contract, or other opportunity nor for any other consequential or indirect loss or damage of a similar nature.

For claims not involving personal injury, death, or illness or which are subject to the Conventions referred to above, any liability the Company may incur for the negligent acts or omissions of its suppliers will be limited to a maximum of the price which you paid for the applicable Tour, not including insurance premiums and administration charges. Where this relates to loss or damage to luggage and other personal possessions then the Company liability will not exceed $1,000 USD. The Company will not at any time be liable for any loss of or damage to valuables of any nature. You agree that you will be precluded from making a double recovery by making the same claims and seeking recovery against the Company and its suppliers, contractors, or other third parties.

Images and Marketing

You agree that, while participating in any Adventure People Travel Club Trip, images, photos, or videos may be taken by other participants, the Company, or its representatives that may contain or feature you. You consent to any such pictures being taken and grants a perpetual, royalty-free, worldwide, irrevocable license to Adventure People, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions, and the creation of promotional materials by or with sub-licenses), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.

Privacy Policy

Adventure People must collect your personal information to deliver the Tour and any products or services booked. The Company collects, uses, and discloses only that information reasonably required to enable the Company and its Third Party Suppliers to provide the particular Trip, products, and/or services that you have requested as described in the Company’s Privacy Policy, which can be accessed any time at https://adventurepeople.net/privacy-policy/ and is expressly incorporated into these Terms. By submitting any personal information to the Company, you indicate your acceptance of the Company’s Privacy Policy.

Severability

If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be the only so broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.

Contract Parties & Successors

These Terms will inure to the benefit of and be binding upon the parties and their respective heirs, legal and personal representatives, executors, estate trustees, successors, and assigns.

Applicable Law

The Contract and these Terms are subject to the laws of California in the United States and you submit to the exclusive jurisdiction of the courts located in Santa Barbara, California for the resolution of any dispute under these Terms or concerning any Tour, product, or service.
